PACHOPOS COSMETICS S.A. having the distinctive title “YELLOW ROSE PROFESSIONAL COSMETICS” that shall hereinafter be referred to as YELLOW ROSE, which is located in Kifissia, Attica, at 15 Menexedon Street, Postcode 14564, Taxpayer’s ID Number: 996940511 and General Business Registry (GEMI) No.: 144727402000, tel: 2108076726, 210-9010816, e-mail address info@yellowrose.gr. The present document is intended to provide information and protection to users navigating the Website, from the online sale of cosmetic products YELLOW ROSE and ADO, as well as cosmetics equipment/machines and accessories, perfumes, etc. Users are kindly requested to keep themselves updated of the terms and conditions mentioned below. Use of this Website implies full acceptance of the terms and conditions stated herein without reservation. YELLOW ROSE reserves the right to modify the terms / conditions of sale at any time and undertakes to inform the Visitors/Users of this Website of any modification or change. If more specific terms are required for the use of a service on the Website, such shall be applied jointly with these present terms, but the more specific terms shall apply in the event of any conflict with the general terms.

PURPOSE OF THIS SERVICE

The website www.yellowrose.gr is the online store (e-shop) for the demonstration and sale of YELLOWROSE and ADO cosmetics by YELLOW ROSE with an independent policy for prices, terms of payment and delivery of products to its Visitors / Users. The Visitor / User is provided with information on the products, the ingredients, their prices and after registering in the e-shop using the option “MY ACCOUNT” and “CREATE ACCOUNT” they can buy the products they want, placing the corresponding order on the e-shop, as a user. Users register once only by stating their e-mail address and a secret Customer Password. Using the unique combination of their e-mail address and password that they have stated, users have the following options. A) To view the content of their “CART”. Users can purchase products, change the type or quality of such in their order, B) To finalize their orders and pay according to the payment methods provided by the e-shop, C) To change their Account details as detailed below, D) To view their order history, view their credit/full payment statements and make electronic use of discount coupons.

VISITING AND USING THE WEBSITE

Adults with competent to act under law and minors having the express consent of their legal guardians have the right to use the Website. YELLOW ROSE is not responsible for any use by Visitors/Users who do not fulfill the above criteria. A visitor is defined as any internet user who visits the www.yellowrose.gr website without registering with the respective e-shop and placing an order. Similarly, a “User” is defined as anyone who registers and places any order on the e-shop.

USER ACCOUNT DETAILS

Data entry during registration: in order to register with the e-shop and place an order, the User provides the following data: Company name - distinctive title, first name, surname, e-mail address, address, postal code, city, country, region, landline or mobile phone, Taxpayer’s ID Number, status and proof of professional status (in the event of registration as a professional). The above details are necessary for the processing of the order by the e-shop and are used exclusively for processing of the User’s order. Use of the User’s data by the e-shop: The possibility of collecting personal data is limited only to Users who: 1. Have placed an order on the e-shop. 2. Have registered through the e-shop page. Collection of personal data is necessary to support their transactions through the e-shop, i.e. sending the items they purchased and so that they may receive special services such as order history, address list, etc. The Website will not distribute Users’ e-mail addresses or other personal data for marketing purposes without the User’s consent.

ORDERS - INFORMATION - SAFETY - PRODUCT PRICES

Each order means acceptance of the general terms and conditions / terms of sale and acceptance of the general terms of use of the Website, personal data and use of cookies without any reservation on these terms. The User prepares his order by adding the products he wishes to purchase to his “CART” following the simple procedure provided by the Website step by step. After being asked to confirm the order, the shipping address for the products and the invoice address, the User is invited to pay, choosing one of the indicated payment methods. The photographs depicting the products are indicative and cannot be binding upon YELLOW ROSE under any circumstances. Furthermore, with regard to the technical characteristics (list of ingredients, etc.) and descriptions of the products mentioned on the website, YELLOW ROSE is exempt from any liability with regard to the validity of their content. The most up-to-date characteristics and descriptions can be found on the product packaging. The customer is responsible for the safe handling of the products and for complying with the safety instructions, which are indicated on the packaging or on an instruction sheet of the product. The prices listed on the Website are in euro and include 24% VAT. YELLOW ROSE reserves the right to modify the prices applicable to the products at any time, but is committed to apply the prices listed on the Website at the time of your order.

VISITOR AND USER OBLIGATIONS

The Visitor and User of the e-shop has the following obligations: 1. To use the Website in a lawful and appropriate manner and to comply with the Codes of Conduct posted on the Website and/or provided for in the relevant legislation in force. LIMITATION OF LIABILITY

Users/visitors who do not trust YELLOW ROSE are advised not to visit or make use of this website or the services offered through it. Furthermore, users/visitors are advised to use software to protect themselves from electronic viruses, Trojan horses, time bombs, or other harmful programs and components. YELLOW ROSE is not liable for side effects and damages from the use of ordered products due to incorrect product selection by the user, careless or incorrect use of the products, or due to the fault of the manufacturer, such as manufacturing defects, incomplete information or instructions accompanying the products, quality of workmanship, safety of materials and actual defects. Our liability in the event of a defective product is limited to the obligation to replace it, provided that the conditions for returning the products are met. YELLOW ROSE is not liable for any shortages in product availability due to reasons of force majeure, weather conditions, fire, supplier strikes, unlawful conduct of third parties and in general reasons that cannot be attributed to the fault of YELLOW ROSE.

YELLOW ROSE is not responsible for any temporary or permanent inability to provide its services and for delays in the acceptance and execution of orders and delivery of ordered products due to reasons beyond its control, such as force majeure, extreme weather conditions, natural disasters, emergencies, strikes, fire, malfunctions of the partner courier companies, accidental deterioration or destruction of the products before delivery to the user and after they have been given for dispatch, unlawful interference by the other party or a third party, malfunction of the Internet Payment Processing Provider (Bank) or the Host Provider or the Internet Service Provider (ISP) or the Access Provider or the User's terminal equipment, incorrect provision of data by the User and in general for any incident that prevents the smooth fulfilment of its contractual obligations.

YELLOW ROSE’s liability is limited to its obligations arising from the contract with the consumer and it will make every effort to meet them within a reasonable period of time. YELLOW ROSE shall not be liable for poor condition of the delivered products if this is not due to inadequate storage of the products and if all the preventive measures it should have taken were indeed taken.
